Telebriefs: The Rights of Job Applicants and Employees with Mental Health Conditions

In December, the Equal Employment Opportunity Commission (EEOC) released a publication entitled, “EEOC Issues Publication on the Rights of Job Applicants and Employees with Mental Health Conditions”. Under the Americans with Disabilities Act of 1990, individuals with mental health conditions are protected from employment discrimination and harassment based on their covered liabilities. In addition, these individuals may also have a right to reasonable accommodations at work. The EEOC’s publication answers questions about how to process requests for reasonable accommodations and what medical information employers are allowed to request from their employees. As explained in this document, charges of discrimination based on mental health conditions are on the rise. Therefore, it is imperative that employers be proactive when dealing with mental health conditions in the workplace.
